AQUINO ADVANCES BILL TO PROTECT TIPPED WORKERS

SPRINGFIELD – A bill sponsored by State Senator Omar Aquino (D-Chicago) that would guarantee tips belong to the workers who earn them passed the Senate today.

House Bill 3405 provides that an employer may not retain gratuities from workers who earn them. Further, the bill would expressly allow tip-sharing between tipped and non-tipped employees.

“When you go to a restaurant and tip your server, you expect that that money will go to them,” said Aquino. “The law does not guarantee that, so this measure will protect the wages that tipped workers earn.”

In March 2018, federal law surrounding worker gratuities changed and House Bill 3405 would align Illinois laws with them.

“Being a server, bartender, cook or cab driver is honest and hard work. The people putting in that work day in, day out deserve to keep the tips given to them for their services,” said Aquino. “The jobs that tipped workers do are by no means easy, and they should be properly compensated for their time and labor.”

House Bill 3405 awaits the governor’s signature.
